Originality is essential to patent grants, and in most cases the originality of AI technology must be discovered in the feature extraction process which precedes the learning step in machine learning models. Originality may also be found in the selection of specific machine learning algorithms, or in fitting or tuning such algorithms according to the purpose of the product or service in question. However, such approaches may not be available if deep learning algorithms are involved. In such cases, originality must be identified in data preprocessing for training data set acquisition, or in applying product or service level deductions. Simply substituting human intelligence for artificial intelligence in general information processing will not ensure patentability. An approach that is entirely different from that of human cognition or perception is required for AI transformation, starting with the types of data collected.
